Bismilah


When two people who got divorced from each other want to get back together again and get married. Why is there this rule in Islam: The wife has to get married to another man first and get divorced from him and only then can she marry her ex-husband again?


I'm confused........Why? What's the reason behind this?

Salam Sister,


This rules can be used only if they divorced <b>three times in the couple's lifetime</b>. The third divorce falls in the third category of divorce which is called "major separation", because they cannot go back to one another, till after the wife ‘happens’ to marry someone else, then ‘happens’ to get divorced by him. In this case, she can go back to her first husband. Such a tough rule was made as <b>a punishment and a way of preventing people from misusing this tolerant ruling of permitting divorce</b>. The word ‘happens’ is parenthesized because the woman's new marriage and divorce should come naturally without planning, <b>as many people might do to legalize her return to the first husband! </b>

They are both my friends and they love each other so much (They would've married long ago, but someone told them that they can't unless the sister marries someone else and gets divorced by him.

Just to clarify the situation, in case this couple were married before and the man divorced the woman already 3 times. They cannt re marry unless she marries another man, (as Wael stressed saying happened to marry) what he wanted to say, is that she cannt conclude a deal with a man to marry the man with the intention of divorcing her just to make her halal for the first husband.


So you have to be very careful passing the info to the couple.


Again, if they are divorced 3 times already, and they are sure that the 3 divorces are valid, then she cannt re marry him unless by chance, by accident, just under normal conditions not induced circumstances or pre planned deals, she marries another man.


As Wael explained Allah Say in Quran:


"The divorce is twice, after that, either you retain her on reasonable terms or release her with kindness. And it is not lawful for you (men) to take back (from your wives) any of your bridal money which you have given them, except when both parties fear that they would be unable to keep the limits ordained by Allah (e.g. to deal with each other on a fair basis). Then if you fear that they would not be able to keep the limits ordained by Allah, then there is no sin on either of them if she gives back (the bridal money or a part of it) for her divorce. These are the limits ordained by Allah, so do not transgress them. And whoever transgresses the limits ordained by Allah, then such are the wrong-doers.* And if he has divorced her (the third time), then she is not lawful unto him thereafter until she has married another husband. Then, if the other husband divorces her, it is no sin on both of them that they reunite, provided they feel that they can keep the limits ordained by Allah. These are the limits of Allah, which He makes plain for the people who have knowledge." (Quran 2:228-230)


As you can clearly read from the Ayahs, the marriage after the 3rd divorce, must be under normal conditions so is the divorce. I mean, she just happened to marry another man then they both fail to continue the marriage for whatever reason (not to let her be allowed to go back to the husband). I know i repeated myself here, but to ensure that the point is made. This is a crucial issue.

When U say divorced 3 times, do u mean when the man says, "your divorced, Your Divorced, Your divorced, at one time. Or do you mean 3 times differently and in those 3 times they got back together then they got divorced?


If thats what you mean then no. They only Divorced once (completely) and have been divorced for that one time only.

Sorry for this late reply, this rule applies on the woman when she is divorced 3 individual times from the same husband and re married him (either before or after Edat). Then after the 3rd time, she is not halal for him any more.


As for the case of your friend, then this rule is not applicable since this is the first divorce indicent between them. May Allah Makes it the last, protect them against all kind of evil and Grants them Taqwa.
