Is the Fatwa about the three months waiting period Iddah? I don't quite get it.


Let me put it this way. There is another situation when the husband divorces his wife by Halalah by saying/divorcing her trice and if they THEN want to remarry she has to marry (of love, necessity not valid according to hadith) another man before that? Is the situation described in this Fatwa another one - they are still married 'on the paper' but not consumating marriage?


The second point is not any easier. The first one sounds understandable that when the waiting period is over - its over. I don't understand the other one that if the period is over everything goes back to 'normal'. Is this the situation even if the husband is still a non-Muslim? To me that sounds like making zina.


Allah o alem sister, this one is tricky. And I must tell you that Shari'ah is not one of my strong sides [Image: sad.gif]


Insha'Allah I will look through my book on Shari'ah and see if I can find anything that relate to this.

No this fatwa is related to a totally different situation. It is related to the woman who reverts. And as I commented, the fatwa says she has to observe Idat which is an implication that the marriage is dissolved. Wallahu a`lam.

Sister Shaunee, I saw the link, now what I read in your previous post and in the link that some scholars said:


"<b>Those scholars based their view upon the ruling of `Umar ibn Al-Khattab, may Allah be pleased with him, in the case of the woman from Al-Heera who reverted to Islam while her husband remained on his religion. According to the authentic narration of Yazeed ibn `Abdullah Al-Khatmi, `Umar ibn Al-Khattab made it optional for the woman to leave her husband or to stay with him. They also cite, in supporting their view, the opinion of `Ali ibn Abi Talib concerning the Christian woman who embraced Islam while still married to a Christian or a Jew. Ali said that her husband’s conjugal right was still inalienable, as he had a contract. This is also an authentic narration. It is also known that Ibrahim Al-Nakha`i, Ash-Shi`bi and Hammad ibn Abi Sulayman had the same view.” </b>



Okay so they permissed it to because of 2 different incidents by Omar(ra) and Ali(ra), but we have Quranic ayas, the word of Allah, that are clear, but u know I will ask our scholar for u and i will tell him your situation and the fatwa about yusuf qaradwi, and I will c what he will say, and what he can advice u to do. and that will not be before saturday unfortunatley, but insha'Allah saturday is soon to come [Image: smile.gif]. Just pray to Allah shaunee pray hard and we will pray for u dont give up and may Allah enlighten the heart of your husband and everything turn just fine well for u dear, may Allah be your guide and assistance.

I want to tell u something else, u might think we are not in your shoes but all of us here realize your difficult situation. U know what Shaunee? The Messenger's daughter went thru this with her beloved husband. If u want to know the story tell me I will post it for u. It is very touching I cry every time I read, tell, or hear it. I take any execuse to tell the story.

One more important point, dont care what u r in the eyes of Muslims, just what u r in the eyes of Allah. And to Allah Insh a Allah u r a Muslim. Shaunee the minute u try to get closer to Allah make sure Allah Shall pull u sooooo close that u wont believe. Just sit and watch Allah the All Capable Working sister.
