A disbeliver is one who does not belive in Allah The Only One Deity Who Is Worthy to worship, who takes associates with Allah, who does not believe in the Prophethood of Mohamed salla Allah A`lyhee wa sallam. Be it Canadaian, Asian, or whatever. Faith is not associated with nationality. In brief a non believer is one who is not a Muslim
As for the intercession, since a martyre has a special position in the eyes of Allah, mind u martyrdom could be obtained under 7 types of death.
One who dies while fighting in the Name of Allah, One who drowns, who dies in fire, a woman while giving or after birth, one who dies under the derbis, who who dies due to tumor near the ribs, who is stabed to death.
Those seven categories as u may see all died through horrandous circumstances which is the Eyes of Allah Is sufficient to protect them totally from Hell fire, not only this but also to be given a privilage of intercession for 70 members of their family. I mean those members would be vlunerable to go to hell and Allah Will give a martyre a chance to talk to Allah, beg Allah to not put them there.
With all due respect to Ibn Rushd, jihad as a word is certainly not restricted on fighting with the sowrd but it rather extends to cover many other aspects as clealy indicated in Quran.
